LaFayette businessman arrested on drug charges




Charges are pending against a town of LaFayette businessman arrested on drug charges last week after allegedly selling crack cocaine to an undercover police informant.

Kirk Brown, 50, owner of Kirk Brown Excavating, 5422 169th Street, is free on $2,500 cash bond. He is to appear in court Feb. 3, at which time a criminal complaint is normally filed.

According to a search warrant document filed in Chippewa County Court this week, controlled drug buys by confidential informants targeted one of Brown’s employees, identified as Robert E. Kent, 46. The buys led to the setting up of a controlled buy from Brown on Sept. 8 during which Brown allegedly boasted of the purity of the crack cocaine. Multiple controlled buys were set up with Kent and Brown in the following weeks, including at Brown’s business.

Investigations of the activities at Brown Excavating continued into December. The search warrant was served late last week and Brown appeared for a bond hearing Dec. 12.

Searches were conducted at Brown’s business, home and cabin. Found in the search were a number of firearms, scales, drug paraphernalia and containers of suspected marijuana. No cocaine was found.

Kent’s residence was also searched, but there is no indication of any illegal substances seized. Kent has not been arrested.

Formal charges have not yet been filed. Typically, a criminal complaint is filed prior to the court date given at the bond hearing, in this case, Feb. 3.

" If i were a judge/candidate, I'd expect a motion to dismiss the charges against brown, except one count of sales of cocaine, which brown will plead guilty to, brown will also agree to co-operate with the investigation, the marijuana possession and paraphernalia charges will be "read in" and thereby forgiven and Browns Jail sentence will seem more like "Ernest goes to treament Kamp" than it will "Kirk Brown goes to Prison"

If what Mr. Gay the ADA alleges in the paper is contained in the affidavits and can be proven to a reasonable certainty.

BROWN will be found guilty of the charges. He is Guilty of being A COCAINE dealer.

Part of a judges obligation to people he Judge's is to see that not only does the state not unnecessarily invade the freedom of one of its citizens but that the state properly safeguards and Prosecutes those that are Accused of crimes against all Citizens.

Justice is truly only arrived by what Judges Define by Action. The judge that accepts a plea deal here, says more about US than it says ABOUT Him "

The fact that Brown was arrested Doesn't mean he was guilty of anything. The affidavits of the UCI (under cover informants) the information relied upon by the judge to Secure the warrants for search and subsequent arrest of brown are the materials in question under review. The state is deciding if federal statutes or state laws are to be used for prosecution. remember in this state jeopardy doesn't attach to a state crime and a person can be found guilty of the same drug crime twice once at state level and second federal level. CCE (continuing a criminal enterprise , RICO federal statutes can be applied if the state can prove Brown used the drug money to conduct business in specific ways.


However,the application of these statutes against Kirk Brown would take more experience than the Judges, Prosecutor and US prosecutor are capable of in our little corner of the state.

" For those of you leaving negative comments, i dont think you know how addiction works, it is a disease, these people are literally sick. i personally know someone addicted who is very close to me and it is very hard for me to see them like that. They start out doing the drug and eventually end up selling it to support their habit, it is very sad. But, that doesnt mean they are bad people, they make bad choices. Wonderful post! I enjoyed reading it over and over again! Let the truth be told! Hopefully Kirk does not get away with this AGAIN! Everytime I go to Ray's Beach, I will now think of the "Guy who did all this work was on cocaine." What a shame.......

And to think the Town of Lafayette gave this person money to do a job which eventually supported his habit and cocaine drug house.....

Kirk gave money for part of the bailout. He has been involved in drugs in the past. Kirk has done some shabby excavating work, (according to previous posts). Kirk was selling crack cocaine to an undercover agent.

This is what we know. We should concentrate on Kirk and not others. It does make us wonder, however, how the people who bailed Julie out got their money and if/what is any connection.
