City ban on smoking likely dead




A ban on workplace smoking in Chippewa Falls has been forcefully snuffed out.

As it did in June, the city’s Transportation Committee on Wednesday voted to wait until the state first takes action on a ban.

But this time it appears there is a majority of the seven member City Council that opposes a ban.

On Wednesday, all three committee members, Susan Zukowski, Jack Covill and Brian Flynn, voted to wait for state action. They agreed a local smoking ban would cause economic hardship to city businesses at a time the economy is struggling.

“Every bar owner in Chippewa looks at this as an attack on their business,” Covill said.

The committee members would likely be joined by another council member, Jason Anderson.

That’s important, because in June on a 4-3 vote the council rejected the committee’s first recommendation to wait for state action. But voting in the majority then was Greg Hoffman, a council member who was later appointed mayor when Dan Hedrington resigned.

Zukowski was appointed by the council to take Hoffman’s 7th Ward council seat.

Anderson, who is not a member of the committee, said if a local ban was approved, smokers would go to bars in neighboring areas without a ban.

“I don’t know if banning it in a local municipality as small as ours will be of any significance health-wise,” Anderson said.

Flynn said everyone agrees that smoking is bad for people, but added, “To me, there needs to be a uniform law.”

The city of Eau Claire began a workplace smoking ban, which includes taverns, on July 1.

Covill said he contacted the Eau Claire Tavern League, which had polled 48 restaurants and taverns over the effect of the smoking ban. According to Covill, they reported an average loss of 30 to 45 percent of business.

One tavern owner looking to retire had thought he would sell his property for $500,000.

“Now he doesn’t think he’ll get more than $100,000,” he said.

Zukowski suggested a possibility would be for the city to hold a referendum on the smoking issue during the November election. Anderson said there would be a cost with a referendum, and that public officials are elected to make decisions.

Anderson read an email from council member Robert Hoekstra, who was unable to attend the meeting. Hoekstra said the public should have been given an advanced notice of the committee’s smoking ban discussion, and that health care professionals should have been part of that discussion.

Hoekstra, a former member of the committee, in June voted against waiting for state to take action on a ban.

The committee’s recommendation will go before the council for a vote Tuesday, Oct. 7.

In other action, the committee voted 3-0 to allow Cathy Coyle to go through the city’s permit process if she wants to continue to sell plants on curb of the boulevard of her residence at 45 E. Birch St.

If they finally get their TOTAL ban, they leave. They have absolutly NO concern about local affairs.Some places have already booted them out of their towns. "

" The City of Chippewa Falls has made the right decision in waiting until the ENTIRE state decides to force the issue of a smoking ban. Turn a blind eye to this decision if you must and stand on your healthy soapbox. The beauty of that statement is you have a personal choice as to where you stand on said soapbox. NO ONE forces you to patronize any of the local establishments.
For those of you who don't smoke, Eau Claire has created an absolute haven. Please visit those establishments and enjoy the fresh air. My understanding is that you won't have to fight for a seat or a bartenders attention. Enjoy responsibly please! "

" gigi08, what is sad is how many people don't understand that private property is private! The Constitution and Bill of Rights protects property owners from the government and the masses. "Property rights form the basis of all freedom". No one is forced onto private property. We spend billions on regulatory agencies in this country. OSHA is responsible for work place safety. Take the fight up with them, and don't ask an elected official to attack a law abiding, tax paying property owner. "

" I am truly disappointed in some of these comments. Everyone knows smoking is a health hazard. But the point remains, it is still legal to smoke. It is not up to local municipalities to make federal laws. In this community there are only 3 restaurants that allow smoking, so instead of blaming city officials, go to the source! Thre are many other serious issues this city is facing, possibly losing city workers which include firefighters and police officers. And before people make assumptions, learn the facts. There have been health care workers who have made statements and allowed to attend meetings. Any adult and child knows smoking is bad, but we as parents and adults make those decisions to go into establishments who allow it. Are you willing ot pay higher taxes if a ban is put into place when businesses shut down and we lose even more police officers because there isn't as much money coming in? Know the facts, than make educated comments. "

And really,no one will ever go to a bar in Chippewa again if they have to step outside to smoke? I somehow doubt that.

I also love how the council sees fit to make health assumptions without any input from actual health officials but takes the Eau Claire Tavern League's word as fact.

Money over health. How sad. "

Mr. Anderson - for that ignorant, uneducated, and just plain stupid comment, I think you should be booted off the council. Just how many victims does it take before a municipality deserves a ban? Eau Claire did it and thankfully for me, I now have a place to go to enjoy a drink or two without having to choke on other peoples smoke all night. Moreover, I don't smell like an ashtray in the morning. Waiting for the state to take action could be years to come and unless municipalities step-up and do something about it, nothing will ever get done. Unfortunately, people are dying in the meantime and it's not only the smokers that are suffering, but also the remaining 83% of the general public that doesn't smoke. In the name of the mighty dollar, you're accomodating 17% of the population that smokes in an effort to keep the bars running smoothly. Statistically, something doesn't seem right here. "
